Our services are managed by Pro Active Formation, supported by Moncher Management, both based in Paris, France, as well as OR Formation Service India, located in Pondicherry, India. We are committed to providing high-quality language courses, including French, English, and Spanish, tailored to your needs and learning pace.

These General Terms of Use (GTU) govern access to and use of our website, as well as the associated services. By accessing our site, you agree to comply with these GTU. We encourage you to read them carefully.

Moncher Learning complies with French laws for financial and contractual aspects and Indian laws for consumer protection and e-commerce due to our target audience. These GTU were last updated on 02/04/2025. We reserve the right to modify them at any time to ensure the best possible experience for our users.

The present General Terms of Use (GTU) are intended to define the conditions for using the website moncherlearning.com (hereinafter "the Site").

By accessing and using the Moncher Learning website, you agree to comply with these General Terms of Use (GTU). These GTU constitute a legal agreement between you and the entities managing Moncher Learning, namely Pro Active Formation, Moncher Management, and OR Formation India.

It is essential that users read these GTU carefully before using the Site. If you do not agree with these terms, please refrain from using our Site. By continuing to browse or use our services, you acknowledge that you have read, understood, and accepted all the terms and conditions set forth in this document.

Article 2 – Access to the Site

To access certain features, it may be necessary to create a user account. You are responsible for ensuring that the information provided during registration is accurate and up to date.

Access to the Site requires an Internet connection and compatible equipment. Moncher Learning cannot be held responsible for any technical or compatibility issues related to your equipment or connection.

We reserve the right to restrict access to certain parts of the Site, or to the entire Site, at our discretion and without notice. Additionally, we may suspend or terminate your access to the Site if you violate these GTU or any applicable laws.

Use of the Site is restricted to individuals aged 18 and over. Persons under the age of 18 must provide a consent certificate signed by their parents or legal guardians in order to use our services.

Article 3 – Creation of a User Account

To access certain features of the website moncherlearning.com, it is necessary to create a user account. When creating this account, the User agrees to:

In the event of suspension or termination of access to the Services, no request for a refund or financial compensation shall be permitted.

Moncher Learning strives to maintain continuous accessibility to its website and Services, 7 days a week and 24 hours a day, subject to maintenance periods, server updates, and exceptional interruptions.

It is the User’s responsibility to ensure that they meet these prerequisites in order to fully benefit from the Services.

Article 12 – Competent Jurisdictions

For the terms of use, disputes shall be subject to Indian jurisdiction, in accordance with the applicable laws in India. For the terms of sale, disputes shall be subject to French jurisdiction, specifically the competent court within the jurisdiction of the Paris Court of Appeal.

These General Terms and Conditions of Sale (GTCS) govern all commercial transactions carried out by Moncher Learning through its website moncherlearning.com. Moncher Learning, through its entities Pro Active Formation and Moncher Management, offers online training services intended for a broad audience.

The purpose of these GTCS is to define the rights and obligations of Moncher Learning and its Clients in the context of the sale of training services. They constitute a legal agreement between Moncher Learning and the Client, who is required to read them carefully before placing an order.

By accessing our services and making a purchase, you agree to be bound by these GTCS. Moncher Learning reserves the right to modify these GTCS at any time, with changes becoming applicable as soon as they are published online.

Article 2 – Scope of Application

These General Terms and Conditions of Sale (GTCS) apply to all sales of training services offered by Moncher Learning on the website moncherlearning.com. They apply without restriction or reservation to all services provided, including online courses, tutoring, coaching, or any other educational service.

These GTCS take precedence over any other general or specific conditions not expressly approved by Moncher Learning. They are accessible at any time on the website and will prevail, where applicable, over any other version or contradictory document.

By placing an order, the Client acknowledges having read and accepted these GTCS. No special conditions may prevail over these GTCS unless formally and explicitly agreed upon in writing by Moncher Learning.

Article 3 – Definitions

In these General Terms and Conditions of Sale (GTCS), the following terms are defined as follows :

  • GTCS : General Terms and Conditions of Sale, governing the sale of services by Moncher Learning.

  • Service : Any training service offered by Moncher Learning, including but not limited to online courses, tutoring, and coaching.

  • Website : Moncher Learning’s website accessible at www.moncherlearning.com.

  • Client : Any natural or legal person placing an order for a Service on the website.

  • Order : Any purchase made by the Client; a request for the purchase of services submitted by the Client to Moncher Learning in accordance with the terms set out in these GTCS.

  • Contract : The contractual agreement consisting of these GTCS and any order accepted by Moncher Learning.

  • Conditions : The present general terms and conditions of sale for the training services provided by Moncher Learning.

  • Training : An educational program, which may be conducted partly or entirely remotely, designed to achieve a professional objective as defined in Article L. 6313-2 of the French Labor Code.

  • Distance Learning : raining delivered and attended remotely via an e-learning platform or Learning Management System (LMS), including, among other things, video consultations, document readings, practical exercises, self-assessment tests and quizzes, and individual or group assignments.

 

Article 4 – Acceptance of the General Terms and Conditions of Sale

Any order placed on the website moncherlearning.com implies full and unconditional acceptance by the Client of these General Terms and Conditions of Sale (GTCS). By confirming their order, the Client acknowledges having read and accepted these GTCS without reservation.

These GTCS are accessible at any time on the website and shall prevail, where applicable, over any other version or contradictory document. Moncher Learning reserves the right to modify the GTCS at any time, with changes taking effect upon their online publication.

No special conditions shall prevail over these GTCS unless formally accepted in writing by Moncher Learning. Any opposing conditions set by the Client shall be unenforceable against Moncher Learning unless expressly agreed upon, regardless of when they were brought to its attention.

Article 5 – Offer and Order

5.1 Essential Characteristics of the Training Programs

The characteristics and descriptions of each training program are specified on the website moncherlearning.com. The administrative and educational conditions are detailed in specific documentation for each training program. Any enrollment request that does not meet these conditions may be refused by Moncher Learning. In any case, it is the Client’s responsibility to ensure that the enrollee meets the required conditions, if applicable.

5.2 Validity of Offers

The offers and prices are specified on the website moncherlearning.com and in the training documentation in effect at the time of enrollment. The offers consist of monthly subscriptions based on the chosen language. If the Client wishes to add another language, a second subscription must be purchased. The subscription ends after 12 months.

5.3 Offer Details

  • Classic : ₹2 699 per month, valid for 12 months. Includes unlimited group classes, access to the online learning platform, and 1 private lesson (1 hour) per month. 12-month commitment.

  • Silver : ₹6 299 per month, valid for 12 months. Includes unlimited group classes, access to the online learning platform, and 3 private lessons per month. 12-month commitment.

  • Gold : ₹8 999 per month, valid for 12 months. Includes unlimited group classes, access to the online learning platform, and 5 private lessons (5 hours) per month. 12-month commitment.

 

The Client places an order directly online by following the process indicated on the website. When placing an order, the Client must verify its accuracy and immediately report any errors.

The order is only considered final after the Client receives an email confirmation from Moncher Learning. Moncher Learning reserves the right to refuse any order from a Client with whom there is an existing dispute regarding the payment of a previous order.

If a service becomes unavailable after the order has been placed, the Client will be informed by email. Moncher Learning will then offer an alternative solution or a refund.

 

Article 6 – Pricing and Payment

The prices of training services are indicated in Indian Rupees (₹) and include all applicable taxes at the time of order. The applicable prices are those in effect at the time of registration, as displayed on the moncherlearning.com website.

Subscription payments are made monthly by credit card or any other payment method available on the website. The Client agrees to provide valid and up-to-date payment information. Moncher Learning reserves the right to suspend access to services in case of non-payment.

The subscription is valid for a period of 12 months. At the end of this period, the Client may choose not to renew the subscription without prior notice. If the Client wishes to cancel their subscription before the end of the 12-month period, they must do so at least 15 days before the end of the current period.

In case of late payment or non-payment, additional fees may be applied. Moncher Learning reserves the right to take any necessary measures to recover the amounts due.

 

Article 7 – Delivery of Services

The training services offered by Moncher Learning are delivered in the form of digital content accessible online via the dedicated learning platform. Once payment is confirmed and registration is finalized, and if applicable, after the legal withdrawal period, the enrolled user receives the necessary login credentials to access their training space and benefit from the content and services.

Enrollment in a training program offered by Moncher Learning is strictly personal. Any transfer of enrollment to a third party or sharing of resources in any form (including full or partial reproduction), whether free or paid, is strictly prohibited and may result in contractual and tort liability for the offender.

The training programs may include online content, downloadable materials, or physical media. Access to courses and educational resources is available 24/7, except during maintenance or technical updates on the website. Moncher Learning strives to minimize these interruptions and maintain high-quality service. This does not apply to private lessons and support services, which are available at specific times agreed upon with the Client.

Access to the online training space requires the enrolled user to comply with Moncher Learning's terms of use, which are available on the moncherlearning.com website. Services are accessible for the duration of the training program.

The Client is responsible for ensuring that their computer equipment and internet connection are adequate to access the services. Moncher Learning cannot be held responsible for access difficulties caused by technical issues beyond its control.

In case of service access problems, the Client is encouraged to contact Moncher Learning’s technical support for prompt assistance and issue resolution.

Article 8 – Registration Terms

8.1 – General Provisions

The order is formalized by submitting a signed registration form. Signing a registration form constitutes a firm and definitive enrollment. Validation of the order entails full payment when applicable. Any choice of training and session is final and cannot be changed or postponed.

For certain training programs requiring specific prerequisites, an evaluation of the applicant’s situation and the submission of supporting documents may be required, leading to a pre-registration phase. The effective order date is the date of registration validation by Moncher Learning, as indicated in the registration confirmation.

Upon receipt of the training agreement or contract, or the individual training protocol signed by all parties, and after the legal withdrawal period in the case of individual enrollment, the login credentials for accessing the online training space will be sent to the enrolled user.

8.2 – Individual Training

Enrollment is subject to the payment of fees. All relevant details on this matter are specified in the registration file for each training program or on the website moncherlearning.com. In the case of a Distance Learning Program, an individual distance learning protocol is also established and sent to the client.

Moncher Learning reserves the right to cancel any registration that does not meet the educational and administrative requirements.

Article 9 – Right of Withdrawal and Refunds

In accordance with applicable legislation, the Client has a period of 14 days from the validation of their registration to exercise their right of withdrawal without having to provide any justification or pay penalties, except if the service provision has already begun with their prior consent.

 

9.1 – Bénéficiaire

Any Client who has enrolled in a training course on an individual basis (as per Article 8.2 of these Terms) may exercise the right of withdrawal.

To exercise this right, the Client must notify their decision to withdraw through a clear and written statement with the subject "Request for Service Withdrawal," sent via email to contact@moncherlearning.com or by postal mail to Moncher Learning’s address.

It is the Client’s responsibility to prove that the withdrawal request has been duly submitted in case of any dispute. If the right of withdrawal is exercised, no amount will be due by the Client. Any payments already made will be refunded via a reversal to the bank card used for the order. In all other cases, reimbursement will be processed via bank transfer upon submission of a bank account identification document if required.

If the withdrawal is made within the stipulated period, Moncher Learning will refund all payments received from the Client within a reasonable time and no later than 14 days from the date Moncher Learning is informed of the withdrawal decision.

No refund will be granted if the withdrawal request is received after the service has commenced, except in cases of exceptional agreement by Moncher Learning.

Article 10 – Cancellation or Withdrawal at the Client’s Initiative

The Client may cancel or withdraw from their training at any time by informing Moncher Learning in writing at contact@moncherlearning.com. However, unless a duly justified force majeure occurs, payments already made will not be refunded.

In case of cancellation or withdrawal, the Client remains liable for the monthly payments until the end of the 12-month commitment period, unless an exceptional agreement is granted by Moncher Learning.

Moncher Learning reserves the right to charge administrative fees for any cancellation or withdrawal not justified by a case of force majeure.

 

Article 11 – Termination of Subscription in Case of Force Majeure

In the event of force majeure, as defined by Indian law, preventing the fulfillment of contractual obligations, the Client may request early termination of their subscription without penalty.

Force majeure includes, but is not limited to, medical issues impacting participation in training, natural disasters, pandemics, armed conflicts, strikes, or any other unforeseeable and insurmountable circumstances.

To invoke force majeure, the Client must provide Moncher Learning with written and documented justification. Moncher Learning will review the request and, if accepted, proceed with the termination of the subscription and reimbursement of any amounts due for services not provided.

 

Article 12 – Guarantees

Moncher Learning commits to providing services that conform to the descriptions and specifications presented on the website moncherlearning.com. The offered training programs are designed to meet the educational and professional needs of Clients, in accordance with the quality standards established by Moncher Learning.

In case of non-compliance with a service, the Client may contact Moncher Learning to request a replacement or a refund. This request must be made in writing and sent to contact@moncherlearning.com, along with all relevant information regarding the order.

Moncher Learning does not guarantee that the services will specifically meet the individual expectations of Clients, particularly in terms of professional results or personal goals. Clients are encouraged to assess their needs and objectives before enrolling in a training program.

Furthermore, Moncher Learning shall not be held liable for temporary service interruptions, technical errors, or connection issues related to the use of the learning platform, except in cases of gross negligence on its part.

 

Article 13 – Liability

13.1 – Liability of Moncher Learning

Moncher Learning shall not be held liable for any indirect damages resulting from the use or inability to use the training services, including but not limited to loss of profits, data loss, or business interruptions.

Moncher Learning's liability is limited to the amount of the order placed by the Client. Under no circumstances shall Moncher Learning be held responsible for any damage resulting from the Client’s misuse of the services.

Moncher Learning shall not be liable for temporary service interruptions, technical errors, or connection issues related to the use of the learning platform, except in cases of gross negligence on its part.

 

13.2 – Liability of the Enrollee

Each enrollee agrees to comply with these Terms and all rules related to the use of Moncher Learning’s various services (educational service, tutoring, etc.) as defined in the Terms of Use. Any behavior that is clearly contrary to public decency (rudeness, harassment, threats, insults, etc.) or the Terms of Use may result in sanctions, including permanent exclusion of the enrollee, without prejudice to Moncher Learning’s right to take legal action before the competent authorities.

The Client is responsible for taking all necessary measures to protect their own data and software from potential viruses circulating on the Internet. Moncher Learning shall not be held liable for any damage caused by viruses or other harmful elements.

13.3 – Evidence Agreement

Given the nature of their exchanges and, in particular, the digital nature of their relationship, the parties agree that all computer records within Moncher Learning’s information system shall serve as evidence in the event of a dispute.

 

Article 14 – Changes to the General Terms and Conditions of Sale (GTCS)

Moncher Learning reserves the right to modify these General Terms and Conditions of Sale (GTCS) at any time, in order to adapt to legal, technical, or commercial changes. The modifications will be applicable as soon as they are posted online on the moncherlearning.com website.

Clients are encouraged to regularly check the GTCS to stay informed of any updates. In the event of a substantial modification to the GTCS, Moncher Learning commits to informing Clients via a notification on the website or by email.

Continued use of the services after the publication of the modifications constitutes acceptance of the new GTCS. If a Client does not accept the changes to the GTCS, they must stop using the services and may terminate their subscription in accordance with the procedures outlined in these GTCS.

 

Article 15 – Applicable Law and Jurisdiction

These General Terms and Conditions of Sale (GTCS) are governed by French law. Any dispute relating to their execution or interpretation will be submitted to the competent courts of Paris, France.

Moncher Learning also strives to comply with applicable Indian laws, particularly in terms of consumer protection and e-commerce, considering our presence and target audience in India.

In the event of a dispute, the Client is encouraged to contact Moncher Learning to seek an amicable solution before initiating any legal proceedings. Moncher Learning commits to reviewing any complaint carefully and attempting to resolve the dispute as promptly as possible.

These provisions do not affect the Client's legal rights as a consumer, including the right to seek alternative dispute resolution methods, such as mediation or arbitration, in accordance with applicable laws.
